I. Acceptance of terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you" or "your") and Detox SARL ("Company", "we", "us" or "our") regarding your use of the Detox mobile application ("App" or "Service"). By downloading, installing, accessing or using the App, you agree to be bound by these Terms.

1.2 Eligibility

You must be at least 18 years old or have reached the age of majority in your jurisdiction to use this App. If you are under 18, you may only use the App with the involvement and consent of a parent or guardian.

1.3 Modifications

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the App. Your continued use of the App after such modifications constitutes acceptance of the updated Terms.

II. Description of service

2.1 Service overview

Detox is a digital wellness application designed to help users manage and reduce their screen time, promote healthy device usage habits, and support digital detoxification. The App provides features including but not limited to:

• Screen time tracking and monitoring
• App usage analytics and insights
• Digital wellness tools and resources
• Usage limit setting and enforcement
• Productivity and focus enhancement features

2.2 Service availability

We strive to provide continuous service availability, but we do not guarantee that the App will be available at all times. The Service may be temporarily unavailable due to maintenance, updates or technical issues.

III. User accounts and responsibilities

3.1 Account creation

To access certain features of the App, you may be required to create an account. You agree to provide accurate, current and complete information during the registration process and to update such information as necessary.

3.2 Account security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to your account.

You agree to use the App in accordance with all applicable laws and regulations. You will not:

5.3 Restrictions

You may not copy, modify, distribute, sell or lease any part of the App, nor may you reverse engineer or attempt to extract the source code of the App, unless such restrictions are prohibited by law.

VI. Disclaimers and limitations

6.1 Warranty disclaimer

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

6.2 Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DETOX SARL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL OR OTHER INTANGIBLE LOSSES.

6.3 Health and wellness disclaimer

The App is designed to support digital wellness and is not intended to diagnose, treat, cure or prevent any medical condition. The App should not be used as a substitute for professional medical advice, diagnosis or treatment.

VII. Subscription and payments

7.1 Subscription services

Certain features of the App may be available through subscription plans. Subscription fees are charged in advance and are non-refundable except as expressly stated in these Terms or required by law.

7.2 Automatic renewal

Subscriptions automatically renew for successive periods unless cancelled at least 24 hours before the current period expires. You may cancel your subscription through your device's account settings.

7.3 Price changes

We may change subscription prices at any time. Price changes will be communicated in advance and will take effect at the start of the next subscription period.

VIII. Termination

8.1 Termination by user

You may terminate your account and stop using the App at any time by deleting the App from your device and contacting us to close your account.

8.2 Termination by Company

We may terminate or suspend your account and access to the App immediately, without prior notice, if you breach these Terms or engage in conduct that we determine to be harmful to other users or our business.

8.3 Effect of termination

Upon termination, your right to use the App ceases immediately. We may delete your account data, though some information may be retained as required by law or for legitimate business purposes.

IX. Governing law and dispute resolution

9.1 Governing law

These Terms are governed by and construed in accordance with the laws of France, without regard to conflict of law principles.

9.2 Jurisdiction

Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of France.

9.3 Dispute resolution

Before pursuing formal legal action, we encourage users to contact us directly to resolve any disputes informally.

X. Miscellaneous

10.1 Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Detox SARL regarding your use of the App.

10.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

10.3 Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

10.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
